Finding Nirvana Wellness, LLC (“Finding Nirvana Wellness,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect through our website at FindYourNirvana.com (the “Site”), our booking tools, and our facility in Venice, Florida; how we use and share that information; and the choices and rights you have. By using the Site or providing information to us, you agree to the practices described in this Policy.

1. Who We Are — and What Privacy Laws Apply

Finding Nirvana Wellness is a non-medical wellness facility. We do not provide medical care, we do not employ or contract with physicians or other licensed clinicians to deliver services, we do not bill health insurance, and we do not create or maintain medical records. Because of this, the information you share with us is consumer information collected by a wellness business — it is protected by this Policy, our contracts with service providers, and applicable consumer-privacy laws, rather than by the federal health-information privacy rules that apply to medical providers and health plans. We say this plainly so you can make informed choices: please do not share medical records, diagnoses, or other clinical information with us, because we are not the right place for that information and we do not need it to serve you.

2. Information We Collect

        Contact and account information. Name, email address, phone number, mailing address, date of birth (to verify age eligibility), emergency contact, account login credentials, and communication preferences.

        Payment information. Payments are processed by our third-party payment processor, Pay Compass Merchant Service. We receive confirmation of payment, card type, and the last four digits of your card; we do not store full payment card numbers on our own systems.

        Booking and usage history. Sessions booked, attended, canceled, or missed; membership tier and status; package and gift-card balances; and facility check-in records.

        Biometric wellness data — with your express consent. If you choose to use our body-composition scan or heart-rate-variability (HRV) and biometric monitoring experiences, the equipment generates wellness measurements about you (for example, estimated body-fat percentage, muscle mass, hydration, heart-rate variability readings). We collect, store, and display this data to you only after you have received express notice and given written consent through the applicable Screening & Acknowledgment form signed before your first session. These readings are informational wellness estimates only and are not medical records or diagnostic data.

        Website analytics and cookies. When you visit the Site, we and our analytics providers automatically collect device and usage data such as IP address, browser type, pages viewed, referring pages, and approximate location, using cookies and similar technologies described in Section 9.

        Communications. Messages you send us by email, text, web form, or social media, and our responses, including accommodation and accessibility requests.

3. How We Use Your Information

We use personal information to: (a) create and manage your account and membership; (b) schedule, confirm, and manage bookings; (c) process payments, credits, and refunds; (d) operate the wellness experiences you select, including displaying your own biometric wellness readings to you; (e) screen for facility-safety eligibility through our acknowledgment forms; (f) communicate with you about bookings, account matters, schedule changes, and policy updates; (g) send marketing communications you have not opted out of (see Section 10); (h) improve the Site and our services through analytics; (i) prevent fraud and enforce our agreements; and (j) comply with legal obligations.

4. How We Share Information — and What We Do Not Do

        Service providers. We share information with vendors who perform services for us — our booking and scheduling platform, payment processor, email and text communication providers, website host, and analytics providers — under contracts that limit their use of your information to providing services to us.

        Equipment data platforms. Body-composition and HRV equipment may store session readings on the manufacturer's or platform provider's system in order to function. We select vendors that contractually limit use of guest data, and we identify the current platform(s) on request.

        Legal compliance and protection. We may disclose information when required by law, subpoena, or court order, or as reasonably necessary to protect the rights, safety, or property of our guests, staff, or business.

        Business transfers. If our business is sold, merged, or reorganized, personal information may transfer to the successor, subject to this Policy or a policy at least as protective.

        We do not sell your personal information. We do not sell or rent personal information — including biometric wellness data — to any third party, and we do not share biometric wellness data with marketers or data brokers. Biometric wellness data is shared only with the equipment/platform vendors necessary to deliver the experience you selected, or as required by law.

5. Retention

We retain personal information for as long as your account or membership is active and as needed afterward to satisfy legal, accounting, dispute-resolution, and recordkeeping obligations. Biometric wellness readings are retained for 7 years following your last session, after which they are deleted or de-identified, unless you ask us to delete them sooner (see Section 7) or a longer period is required by law. Signed waivers, screening forms, and transaction records are retained consistent with applicable statutes of limitation.

6. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, encrypted transmission for payment and account data, and vendor due diligence. No method of transmission or storage is completely secure, so we cannot guarantee absolute security; if we learn of a breach affecting your personal information, we will notify you as required by Florida's Information Protection Act, Fla. Stat. § 501.171.

7. Your Choices and Rights

Regardless of where you live, we extend the following to all guests and members:

        Access. You may request a copy of the personal information we hold about you, including your biometric wellness readings.

        Correction. You may ask us to correct inaccurate information.

        Deletion. You may ask us to delete your personal information, including biometric wellness readings. We will honor deletion requests except where we must retain information for legal, safety, or recordkeeping reasons (for example, signed waivers and payment records), in which case we will tell you what we kept and why.

        How to submit; timing. Submit requests to [email protected] or at the front desk. We will verify your identity and respond within 30 days, and we will not charge a fee or discriminate against you for making a request.

8. Children

The Site is not directed to children, and we do not knowingly collect personal information online from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete it. Guests under 18 may participate in eligible facility experiences only through a parent or legal guardian, who provides and controls the minor's information and signs all applicable forms.

9. Cookies, Analytics, and Tracking — Your Opt-Outs

The Site uses: (a) essential cookies required for the Site and booking tools to function; (b) analytics cookies (such as Google Analytics 4 (GA4) and Google Tag Manager (GTM)) that help us understand Site usage; and (c) advertising/retargeting pixels. You can control cookies through your browser settings (including deleting or blocking cookies), use the analytics provider's published opt-out tools, and opt out of interest-based advertising through industry tools such as the NAI and DAA opt-out pages. Some browsers transmit “Do Not Track” or Global Privacy Control signals; at this time we do not currently respond to such signals. Disabling non-essential cookies will not prevent you from booking sessions.

10. Marketing Communications

With your consent or as otherwise permitted by law, we may send you marketing emails and, if you opt in, text messages about offers, events, and new experiences. Every marketing email we send complies with the federal CAN-SPAM Act: it will identify us as the sender, include our physical postal address, and contain a working unsubscribe link, and we will honor unsubscribe requests within ten (10) business days. You may opt out of texts by replying STOP. Opting out of marketing does not affect transactional messages such as booking confirmations and account notices.

11. Florida Privacy Law Note

Independent of any specific statute, we voluntarily extend the access, correction, and deletion rights described in Section 7 to all guests.

12. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy on the Site with a new effective date and, for material changes affecting information we have already collected (including any material change to how we handle biometric wellness data), we will provide advance notice by email or in-facility posting and, where required, obtain your consent before applying the change.
