Welcome to the website of Finding Nirvana Wellness, LLC (“Finding Nirvana Wellness,” “we,” “us,” or “our”), located at findyournirvana.com (the “Site”). These Terms of Service (these “Terms”) govern your access to and use of the Site, including any content, functionality, online booking tools, and purchases offered on or through the Site. By accessing or using the Site, creating an account, booking a session, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
1. Who We Are — A Wellness Facility, Not a Medical Provider
Finding Nirvana Wellness is a non-medical wellness facility offering self-directed wellness experiences such as infrared sauna, cold plunge, contrast practice, red light sessions, compression sessions, PEMF sessions, and related amenities to guests and members for general wellness, relaxation, and personal enjoyment. We are not a medical facility, clinic, or health care provider, and no physician, nurse, or other licensed clinician supervises, directs, or participates in the experiences offered at our facility or described on the Site.
NO MEDICAL ADVICE. ALL CONTENT ON THIS SITE — INCLUDING TEXT, GRAPHICS, IMAGES, DESCRIPTIONS OF WELLNESS EXPERIENCES, BLOG POSTS, FREQUENTLY ASKED QUESTIONS, AND LINKS TO OTHER MATERIALS — IS PROVIDED FOR GENERAL WELLNESS INFORMATION ONLY. SITE CONTENT IS NOT MEDICAL ADVICE, IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT, AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, MITIGATE, OR PREVENT ANY DISEASE OR HEALTH CONDITION. NOTHING ON THIS SITE, AND NO USE OF OUR FACILITY OR SERVICES, CREATES A PHYSICIAN-PATIENT, PROVIDER-PATIENT, OR OTHER CLINICAL RELATIONSHIP BETWEEN YOU AND FINDING NIRVANA WELLNESS OR ANY OF ITS OWNERS, EMPLOYEES, OR CONTRACTORS. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION, AND NEVER DISREGARD OR DELAY SEEKING PROFESSIONAL MEDICAL ADVICE BECAUSE OF SOMETHING YOU HAVE READ ON THIS SITE. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.
2. Eligibility
• Age 18 or older. You must be at least 18 years of age to create an account, book sessions, or make purchases through the Site.
• Minors. Guests under 18 may participate in eligible facility experiences only when enrolled, booked, and accompanied as required by a parent or legal guardian who has signed the applicable agreements and acknowledgment forms. Minors may not create their own Site accounts.
• Accuracy. You represent that all information you provide through the Site is truthful, accurate, and current, and that you have the legal capacity to enter into these Terms.
3. Account Registration
Certain Site features, including online booking and membership management, require you to register for an account. You agree to: (a) provide accurate and complete registration information; (b) maintain the security and confidentiality of your login credentials; (c) promptly notify us of any unauthorized use of your account; and (d) accept responsibility for all activity that occurs under your account. We may suspend or terminate any account that we reasonably believe has been used in violation of these Terms, used fraudulently, or shared with another person.
4. Online Booking; Cancellations, Late Arrivals, and No-Shows
The Site allows guests and members to reserve session times for facility experiences. By booking, you agree to the following terms, which we apply uniformly and disclose at the time of booking:
• Booking confirmation. A booking is confirmed only when you receive an electronic confirmation. Session times are subject to availability and facility capacity.
• Cancellation window. You may cancel or reschedule a booked session without charge up to 24 hours before the scheduled start time, using the Site, our booking application, or by contacting us at the contact information below.
• Late cancellation. Cancellations made less than 24 hours before the scheduled start time may be charged a late-cancellation fee of 25% of non-member rates or, for members and package holders, may result in the deduction of the session from your membership allotment or package, as described in the Membership Agreement or Package & Gift Card Terms.
• No-shows. If you fail to arrive for a booked session without canceling, we may charge a no-show fee of 50% of non-member rates or deduct the session from your allotment or package.
• Late arrivals. Arrivals more than 5 minutes after the scheduled start time may be treated as a no-show or result in a shortened session, at our reasonable discretion, to avoid disrupting other guests.
• Our cancellations. If we must cancel a session (for example, for equipment maintenance, weather, or safety reasons), we will make reasonable efforts to notify you and will offer a rebooking or, where applicable, a credit or refund consistent with our Refund & Cancellation Policy.
• Screening still required. Booking a session online does not waive any in-facility requirement, including completion of the applicable screening and acknowledgment forms and the Master Facility Waiver & Release before participation.
5. User Conduct
You agree not to: (a) use the Site in any way that violates applicable federal, state, or local law; (b) impersonate any person or misrepresent your affiliation with any person or entity; (c) book sessions you do not intend to use, engage in fraudulent purchases, or abuse promotional offers; (d) interfere with or disrupt the Site, its servers, or its security features, or attempt to gain unauthorized access to any portion of the Site or other users' accounts; (e) use any robot, scraper, or other automated means to access the Site or harvest content or data; (f) upload or transmit viruses or other malicious code; or (g) post or transmit content that is unlawful, defamatory, obscene, harassing, hateful, or infringing of any third party's rights.
6. Reviews and User-Generated Content
The Site or our pages on third-party platforms may permit you to post reviews, comments, photos, testimonials, or other content (“User Content”). For any User Content you submit:
• License. You grant Finding Nirvana Wellness a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, reproduce, display, distribute, adapt, and publish your User Content in connection with the Site and our marketing, in any media, with or without attribution. You retain ownership of your User Content.
• Your representations. You represent that your User Content is your own, is truthful and based on your genuine experience, and does not infringe any third party's rights, violate any law, or disclose another person's private information without consent.
• No health claims. User Content describing personal wellness experiences reflects only the individual's own subjective experience. We do not adopt, verify, or endorse any health-related statement in User Content, and such statements are not claims by Finding Nirvana Wellness about the effects of any experience.
• Takedown; moderation. We may (but are not obligated to) review, screen, edit for length, decline to post, or remove any User Content at any time for any reason, including content we reasonably believe is false, unlawful, abusive, off-topic, or in violation of these Terms. To request removal of content that infringes your rights, contact us at the address in Section 14 with a description of the content, its location, and the basis for removal; we will review and respond within a commercially reasonable time.
• Honest reviews. Nothing in these Terms prohibits or restricts your ability to leave a truthful review of our facility, and we do not impose penalties or fees for honest reviews. This section is intended to comply with the federal Consumer Review Fairness Act, 15 U.S.C. § 45b.
7. Intellectual Property
The Site and all of its contents — including the Finding Nirvana Wellness name, logo, trade dress, text, graphics, photographs, videos, page designs, and software — are owned by or licensed to Finding Nirvana Wellness, LLC and are protected by United States and international copyright, trademark, and other intellectual-property laws. You may view, download, and print Site content for your personal, non-commercial use only. No other use — including reproduction, modification, distribution, republication, or creation of derivative works — is permitted without our prior written consent. All rights not expressly granted are reserved.
8. Third-Party Links and Services
The Site may contain links to third-party websites, applications, or services (including our booking platform, payment processor, and social-media pages). These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or terms of any third-party site or service, and a link does not imply our endorsement. Your use of third-party sites and services is at your own risk and subject to their own terms and privacy policies.
9. Online Purchases; Incorporated Agreements
The Site may allow you to purchase memberships, day passes, session packages, gift cards, and retail products. All purchases made through the Site are governed by, and expressly incorporate by reference, the following documents as applicable to your purchase, each of which is available at the facility and on the Site:
• Memberships. The Finding Nirvana Wellness Membership Agreement and the Enrollment & Recurring Payment Authorization, including the Refund & Cancellation Policy and the Freeze/Hold & Transfer Policy.
• Day passes. The Day Pass Agreement.
• Packages and gift cards. The Package & Gift Card Terms.
• Retail products. The Consumer Product Terms (including product disclaimers and return terms).
In the event of a conflict between these Terms and a document listed above with respect to the product or service it governs, the listed document controls. All prices are stated in U.S. dollars and are subject to the Fee Schedule & Cash-Pay Pricing Disclosure in effect at the time of purchase. We may decline or cancel any order for suspected fraud, pricing error, or unavailability; if we cancel a paid order, we will refund the amount paid for the canceled item.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY ON THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FINDING NIRVANA WELLNESS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY SITE CONTENT, AND ANY RELIANCE ON SITE CONTENT IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FINDING NIRVANA WELLNESS, LLC AND ITS OWNERS, MANAGERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US THROUGH THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Savings clause — your non-waivable rights preserved. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. Nothing in these Terms limits, excludes, or modifies: (a) any right or remedy you have under the Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. §§ 501.201–501.213 (FDUTPA), or any other consumer-protection statute, to the extent that right or remedy cannot lawfully be limited or waived by agreement; (b) liability that cannot be excluded under applicable law, including liability for our own gross negligence, intentional misconduct, or fraud; or (c) any in-facility waiver or release you sign, which is governed by its own terms. These Terms are to be read so as to preserve, not displace, your non-waivable statutory rights.
12. Indemnification
You agree to indemnify and hold harmless Finding Nirvana Wellness, LLC and its owners, managers, members, employees, and agents from and against any third-party claims, damages, liabilities, and reasonable costs (including attorneys' fees) arising out of your User Content, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Site. This section does not apply to claims arising from our own negligence or misconduct and does not limit any right you have under FDUTPA or other applicable consumer-protection law.
13. Dispute Resolution; Governing Law
Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the hearing held in Sarasota County, Florida (or conducted remotely by agreement). YOU AND FINDING NIRVANA WELLNESS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. This arbitration provision does not apply to small-claims court actions within that court's jurisdiction, and it does not waive any right or remedy that cannot lawfully be subject to mandatory arbitration. The Federal Arbitration Act governs this provision.
These Terms and any dispute arising out of them are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Before initiating any formal proceeding, you agree to first contact us in writing and allow thirty (30) days for informal resolution.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on the Site with a new effective date and, for registered account holders, provide notice by email or in-app message at least 30 before the changes take effect. Changes will not apply retroactively to purchases already completed. Your continued use of the Site after the effective date of updated Terms constitutes acceptance of the updated Terms; if you do not agree, your sole remedy is to stop using the Site.
15. Miscellaneous
These Terms, together with the documents incorporated by reference in Section 9 and our Website Privacy Policy, are the entire agreement between you and Finding Nirvana Wellness regarding the Site. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force, and the invalid provision will be enforced to the maximum extent permissible. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business. Section headings are for convenience only.
